What’s New for Employers in Taiwan: Insights from ECOVIS Taiwan

French Chamber Taiwan is pleased to share three recent legal updates from our member ECOVIS Taiwan, covering changes that affect employers in Taiwan: marriage leave extended to 14 days, new rules on early settlement of retirement benefits under the old pension system, and the opening of employee stock ownership trusts to foreign employees.

Marriage Leave Extended to 14 Days

From October 2026, Taiwan’s Ministry of Labor has extended statutory marriage leave from 8 to 14 days, in line with the leave civil servants already get. Employers can apply for a government subsidy to cover the wages paid for the 6 extra days. The subsidy does not apply if other laws already require employers to give more than 8 days of paid marriage leave.

Early Retirement Benefit Settlement Limited to Old Pension System Employees

In a letter dated September 1, 2026, the Ministry of Labor clarified that only employees covered solely by the old pension system can agree with their employer to settle retirement benefits early and move the full amount into their individual pension accounts. They must stay with the same employer. Employees who make voluntary pension contributions do not qualify automatically. The rule also excludes self-employed persons, working employers, commissioned workers, and other workers not covered by the Labor Standards Act.

Foreign Employees Can Now Join Employee Stock Ownership Trusts

To help companies attract global talent, the Financial Supervisory Commission will let foreign employees of listed and OTC-listed companies, and their affiliates, take part in employee stock ownership trusts. Trust companies will be able to buy shares for foreign employees through the same investment accounts used for Taiwanese staff. This fixes the problem of small monthly contributions being hard to invest through separate accounts. The change should take effect in Q4 2026. Read more on our website.
